Booking Conditions

Your agreement is with Afririkki Trips and a contract is formed when you make a reservation with us that we accept. Enrollment in and payment for a trip shall constitute acceptance by the person traveling of the terms and conditions in this document. These cannot be varied except in writing by the representative of the Company. All contracts with Afririkki Trips are made subject to the terms of these booking conditions. We reserve the right to change these booking conditions at any time prior to you making a booking.

RESERVATIONS & PAYMENTS

Prices are listed in US dollars and all payments must be made in US dollars by credit card, check, or wire transfer.

A deposit of $250 per person is required to secure your reservation. To secure reservations on a trip departing within 90 days, full payment may be required by credit card at the time of booking. Payment of your deposit indicates your acceptance of these terms and conditions. Final payment for boat tours must be made in full to Afririkki Trips at least 90 days prior to departure; all other destinations require payment in full to be made at least 60 days prior to departure. Afririkki Trips reserves the right to cancel your reservation if final payment is not received by the due date and cancellation charges will apply. Tour prices listed are per person and based on double occupancy.  We reserve the right to correct inadvertent pricing or other errors.

PRICES

Note that the Company reserves the right to amend the tour price if time lapses between the date the Quotation is submitted to the client and the date the payment of the tour price is received in its bank account.

The prices are quoted at the ruling daily exchange rate and based on hotel and other relevant prices on the date of the Company’s quote. Until the Company has received payment of the tour price in full, it reserves the right to charge any fluctuations to the client’s account and the client undertakes to pay for any such fluctuation on demand.

Any refusal to pay the additional charge due to fluctuations will be regarded as a cancellation by the client and the client will be liable for the applicable cancellation fee as set out herein. However, once payment of the quoted and confirmed tour price in full is received, the tour price is guaranteed (subject to statutory increases such as taxes and bed levies) Should it be a booking involving a group of travelers and the group number deviates from the number specified for the Booking, The Company reserves the right to re-cost the tour price and raise a surcharge. Should any client refuse to accept and pay such surcharge, the Company reserves the right to cancel the tour and retain any payment made. The client is responsible for checking for any changes in pricing prior to effecting a full and final settlement of the tour price.

PARTICIPANT NUMBERS

Open Groups: Maximum numbers: In order for us to give a more personal experience and to maintain client safety, in open group events, a maximum number of participants will be clearly displayed for each event.  If the maximum number of participants is reached, we will operate a waiting list.  Where possible we will supply an extra leader but this cannot always be guaranteed.  Minimum group numbers for an open group is 2 clients.

Private groups: the maximum amount of clients in a group is limited by the number of leaders that can be supplied in a ratio of 1 leader and up to 10 clients. A minimum number of 1 client is required for a private group booking.

CHANGES IN PLANS MADE BY THE CLIENT

For any changes you make to your reservation prior to your final payment date that affect destination, departure date, program extensions, or departure city, we will longer charge a $80-per-person administrative fee.

Please note: Canceling a reservation is not a change. Please review our cancellation policy below.

CANCELLATIONS & REFUNDS

The initial deposit of $250 is required for published tours and refundable within 14 days upon written request. After that, the initial deposit is non-refundable.

The following cancellation penalties apply:

    More than 90 days: Nil

    25% of trip price: 90 to 61 days before departure

    50% of trip price: 60 to 31 days before departure

    100% of trip price: 30 to 0 days before departure

Note that Refund and Cancellation terms for custom tours may vary and will be specified in quotes and proposals for that tour.

CANCELLATION BY THE COMPANY

Occasionally, we do have to make changes, and we reserve the right to do so at any time. Most of these changes are minor, and we will advise you of them at the earliest possible date.

We also reserve the right in any circumstances to cancel your travel arrangements. For example, if the minimum number of clients required for a particular travel arrangement is not reached, we may have to cancel it. However, we will not cancel your travel arrangements less than 8 weeks before your departure date, except for reasons of force majeure or failure by you to pay the final balance.

If we are unable to provide the booked travel arrangements, you can either have a refund of all monies paid or accept an offer of alternative travel arrangements of comparable standard from us if available (we will refund any price difference if the alternative is of a lower value).

If it is necessary to cancel your travel arrangements, we will pay to you compensation as set out in the table below.

FORCE MAJEURE

Except where otherwise expressly stated in these Booking Conditions we are unable to accept liability or pay compensation where the performance or prompt performance of our contractual obligation is prevented or affected by reason of circumstances amounting to ‘force majeure’ i.e. any event which we or the supplier(s) of the service(s) could not, even with due care foresee or avoid. Such events may include, but are not limited to, war, threat of war or civil commotions, riots, terrorist activity, industrial dispute, natural or nuclear disaster, adverse weather, fire, flood, drought, government action, airport and port regulations and closures, technical transportation problems, maintenance to vessels, scheduling of transport and similar events outside our control.

A flight or ship delay does not constitute a change to holiday arrangements.

UNUSED PORTION OF TRIP 

No refunds will be provided for any unused portion of a trip once the trip begins, including but not limited to if you leave a trip for any reason, miss the trip’s departure date or an activity, or have to be removed from a trip. There are no exceptions to this cancellation and refund policy, including for reasons related to weather, civil strife, personal, family or medical emergencies or any other circumstances beyond our control. For this reason, we highly recommend that you purchase travel insurance.

TRAVEL INSURANCE

We strongly recommend that you purchase a travel protection plan to cover all non-refundable trip expenses, trip delay and interruption with return transportation and a medical evacuation policy. Travel insurance is available through third-party travel insurance companies, and limits vary by insurer and policy purchased. Insurance will cover most losses, but coverage may vary. No representation or description of the insurance made by our staff constitutes a binding assurance or promise about the insurance.

ITINERARY CHANGES

Afririkki Trips reserve the right to re-route the itinerary or amend the arrangements of any tour in case of unexpected adverse circumstances beyond our control. It is essential to understand that in West Africa local conditions are not always predictable; occurrences as border closure, poor road conditions, etc. can cause delays, disturbances, and modifications of the initial itinerary. We shall make every effort to minimize inconveniences but cannot accept responsibility for matters which are clearly beyond our control.

PASSPORTS &VISAS

You assume full and complete responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements of your destination and your connecting points, and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination. Many countries require your passport to be valid for six months or more after your date of entry. Some countries will not admit persons convicted of a crime. Some countries require both parents’ consent for minors to travel.

LUGGAGE

Generally we can accommodate on all transfers, pick up and drop off, one suitcase and one carry-on bag per person. If you exceed this limit there may not be space in the vehicle to transport your excess luggage. There may be additional cost to have dedicated transportation for you and your additional luggage.

Should you be intending to travel with additional luggage, you are required to notify Afririkki Trips on the extent of additional luggage not less than 7 days prior to your date of arrival to enable suitable transportation to be arranged.

We recommend you bring a day pack for days tours to carry water, guide-books, jacket, rain gear, etc.

RISKS OF TRAVEL AND RELEASE

We assume no responsibility for and shall not be liable for the acts or omissions on the part of any other party not under our control or any acts of God, unsafe conditions, terrorism, health hazards including pandemics, illness, weather hazards, or contraction of or exposure to an infectious disease, bacteria or virus including COVID-19. We have no special knowledge of dangers during travel or at destinations. For information related to such dangers, we recommend going to the State Department travel website at www.travel.state.gov, click on “Find International travel Information” then click on “Country Information”, and fill in the name of the destination country. For medical and health information, we recommend going to the Centers for Disease Control website at www.cdc.gov/travel, then click on “Destinations” and scroll to the name of the destination country. YOU HEREBY EXPRESSLY ASSUME ALL OF THESE RISKS AND DANGERS, AND YOU HEREBY EXPRESSLY AGREE TO FOREVER RELEASE, DISCHARGE AND HOLD US, AND OUR AGENTS, EMPLOYEES, OFFICERS, DIRECTORS, ASSOCIATES, AFFILIATED COMPANIES, GUIDES, GROUP LEADERS, AND SUBCONTRACTORS HARMLESS AGAINST ANY AND ALL LIABILITY, ACTIONS, CAUSES OF ACTIONS, SUITS, CLAIMS, AND DEMANDS OF ANY AND EVERY KIND AND NATURE WHATSOEVER WHICH YOU NOW HAVE OR WHICH MAY HEREAFTER ARISE OUT OF OR IN CONNECTION WITH THE TOUR OR PARTICIPATION IN ANY ACTIVITIES IN WHICH YOU PARTICIPATE.

JURISDICTION

This contract is governed by USA Law. In the unlikely event that any dispute arising out of or in connection with this contract cannot be settled amicably between us, it shall be referred to ad hoc arbitration. The seat of the arbitration is to be in Albuquerque, New Mexico.
